Terms of Service

These Terms of Service ("Terms") govern your use of Captioned, a product of Anear Incorporation Private Limited ("Anear," "we," "us," or "our"), a company incorporated in India. By creating an account or using Captioned, you agree to these Terms.

1. Description of Service

Captioned is a web application that generates social media captions using AI, based on details you provide (niche, topic, tone, and optionally a saved brand voice). We offer a free tier with limited monthly usage, and paid subscription plans (Starter and Studio) with higher or unlimited usage and additional features.

2. Eligibility and Account Registration

You must be at least 18 years old to create an account. You're responsible for keeping your login credentials secure and for all activity that happens under your account. If you sign up using Google, you're also subject to Google's own terms for that sign-in method.

3. Subscription Plans and Billing

Paid plans are billed in advance on a recurring basis (monthly or annually, depending on what you choose at checkout) through our payment processor, Dodo Payments. Subscriptions automatically renew at the end of each billing period until cancelled.

4. Cancellation Policy

You can cancel your subscription at any time from your dashboard. When you cancel:

• Auto-renewal is turned off immediately
• You keep access to your plan's features until the end of the billing period you've already paid for
• We do not provide refunds or credits for partial billing periods
• At the end of the period, your account moves to the free tier

This is the standard cancellation approach used by most subscription software, and it's exactly how billing works on the backend of Captioned.

5. Free Tier Limits

Free accounts are limited to a set number of caption generations per calendar month (currently 7). This limit is subject to change, and we'll make reasonable efforts to communicate any changes on our pricing page.

6. Acceptable Use

You agree not to use Captioned to generate content that is illegal, defamatory, harassing, hateful, sexually explicit, or that infringes on someone else's intellectual property or rights. We reserve the right to suspend or terminate accounts that misuse the service.

7. AI-Generated Content - What You Should Know

Captions are generated using a third-party AI model (Anthropic's Claude). Like any AI-generated content, outputs may occasionally be inaccurate, generic, or need editing before you post them. We don't guarantee that any generated caption is factually correct, original, or suitable for every context. You're responsible for reviewing content before you publish it anywhere.

8. Ownership of Generated Content

As between you and us, any caption generated for your account is yours to use, edit, and publish as you see fit. We don't claim ownership over the captions you generate or the brand voice text you provide us.

9. Our Intellectual Property

The Captioned name, logo, website, and underlying software are owned by Anear Incorporation Private Limited. Nothing in these Terms grants you any rights to our trademarks or software beyond what's needed to use the service as intended.

10. Disclaimer of Warranties

Captioned is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the service will be uninterrupted, error-free, or that generated content will meet your specific requirements.

11. Limitation of Liability

To the fullest extent permitted by law, Anear Incorporation Private Limited will not be liable for any indirect, incidental, or consequential damages arising from your use of Captioned, including any loss of data, revenue, or business opportunity.

12. Termination

You may stop using Captioned and cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms, misuse the service, or if we discontinue the product, with notice where reasonably possible.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of Captioned will be subject to the exclusive jurisdiction of the courts of India.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use Captioned after changes take effect means you accept the revised Terms.
